DialATire.com is owned and operated by Quick Pit Tires Trading LLC which was registered in Dubai in 2014 under license number 708099. DialATire.com is maintained, owned, and run by Quick Pit Tires Trading LLC and is accessible online through the Uniform Resource Locator (URL) DialATire.com.
'Conditions' means these terms and conditions that govern the use of this website for placing orders for tyres and to have those tyres fitted in the appropriate manner.
'Contract' means the contract for sale and purchase of products detailed in the order confirmation between the company and the customer.
'Customer' means any person or entity placing an order to purchase products or services displayed on DialATire.com.
'Customer's Order' means the request made by customer to purchase specific goods from DialATire.com by following the steps, guided by information and completing the required information and specifications during the checkout.
'Sale' means the tyres and related services offered by Quick Pit Tires Trading LLC through DialATire.com. Services may include the installation of tyres through mobile van or at installer location of Quick Pit Tires Trading LLC.
The word 'Goods' refers to all products related to tyres, fitting services and associated goods which can be purchased via DialATire.com and which are subject to these Conditions.
The words 'Confirmation of Order' mean the written notice sent to the customer which confirms that their order has been accepted and that the company agrees to supply the Goods that are set out. The Confirmation of Order may be sent by email, electronically, or in writing.
The phrase ‘Force Majeure’ means any event that is not foreseeable or controllable and that prevents either party from performing its obligations under these Conditions. Events of Force Majeure may include, but is not limited to, acts of nature (e.g. floods, earthquakes, storms, or lightning), explosions, fires, wars or threats of war, riots, government-related prohibition or restriction, strikes, lock-outs, embargoes, export ban, political or labour disputes, trade disputes, or shortages of labour or materials, power failure, fuel shortages, mechanical failure or anything else respectively outside the reasonable control of the affected party.
Conditions of Sale
Under these terms and conditions of sale, the Customer purchases products and services from DialATire.com in accordance with the definitions and procedures set out under ‘Customer’s Order’ and ‘Order Confirmation.’ The contract between DialATire.com and the Customer is governed under these terms, which detail how a products is offered and accepted or rejected by either party.
By proceeding to purchase products and services through DialATire.com, the Customer acknowledges and agrees that all of the content on the website - including, but not limited to, descriptions, images, specifications, price list, and associated literature - is an indication that the Customer can purchase that product. The content is not an offer by DialATire.com to sell that product until DialATire.com issues an Order Confirmation.
A modification or change to these Conditions is not effective or binding unless agreed in writing and signed by Quick Pit Tires Trading LLC, DialATire.com operating company, as well as the Customer (or authorized representative, if applicable).
Employees, representatives, or agents of DialATire.com have no authority to make any statements, promises, or representations about DialATire.com, or the goods or parts, unless those statements have been formally sanctioned or documented by DialATire.com. Customer acknowledges that no such representation will be part of the Contract unless it has been confirmed in writing.
Any verbal advice, recommendation, or guidance provided by employees, agents, or representatives of DialATire.com regarding storage, handling, installation, or use of goods will only be binding if provided in writing and authorized by DialATire.com. DialATire.com shall not be liable for following unauthorized or informal advice.
Although DialATire.com takes reasonable precautions to ensure the reliability and accuracy of the website content, product information, and communications, DialATire.com reserves the right to correct typographical errors, clerical errors, ommissions, or inaccuracies in product description, service description, pricing, invoices, or any other published materials, and will have no liability in connection with such errors. Such corrections may be made at any time, either pre or post acceptance of a Customer's Order.
DialATire.com attempts to maintain the accuracy and timeliness of stock information on its website, which is typically updated on a regular basis. However, in the event a product goes out of inventory or stock after the Customer places an order, DialATire.com reserves the right to cancel the Customer's order and issue the Customer a full refund of any payments for the order, regardless of whether the Customer purchased the product or service online or offline.
DialATire.com also clarifies that items listed under promotional or discounted pricing are already offered at the best possible value. Accordingly, such products are not eligible for any additional discount programs or partner card benefits, including but not limited to Fazza, Esaad, or Emirates Platinum. All promotional prices published on the website are considered final and are structured to maintain transparent and consistent pricing for all customers.
Conditions of Offers
An order made by the Customer is not fully processed or accepted by DialATire.com until an Order Confirmation is given by the company and received by the Customer. The order will become valid and binding only when the Customer receives the Order Confirmation.
The Customer shall be solely responsible for the correctness, completeness, and accuracy of the information provided by the Customer during the ordering process and must also provide any additional information requested by DialATire.com in order to process the order in a timely manner and to allow the company to contact the Customer as set forth in these Conditions.
The quality, specifications, and quantity of the products delivered will comply with the Order Confirmation. The Customer and DialATire.com will agree to any amendments in writing before products can be dispatched.
DialATire.com holds the complete authority and right to change specifications, designs, prices, descriptions, or other details related to the products at any time without notice, whether or not these specifications, designs, prices, or other details are in the Order Confirmation. Additionally, DialATire.com maintains the authority to amend these Conditions at any time in order to comply with new laws or regulations or to meet internal requirements of the company.
Once an Order is placed, it will not be assumed cancelled. Cancellation will only take effect upon receipt of written confirmation deeming cancellation effective and acknowledged by DialATire.com. If the Customer cancels an Order without written confirmation that the cancellation was effective, then the Customer shall indemnify DialATire.com against any subsequent losses or expenses, including but not limited to any loss of profits, labour expenses, material costs, logistics, damages, and administration related to the Order.
Unless there is a written statement that indicates otherwise, no discounts, offers, or promotional codes may be applied to the listed price of the Tyre on DialATire.com.
Conditions of Goods Pricing
All prices for products and services displayed on DialATire.com and shown on the Order Confirmation will be established by Quick Pit Tires Trading LLC. Where nothing is specifically priced on the Order Confirmation the price that shall apply and be binding under these Conditions is the price that is provided on the DialATire.com website for that product or service at the time and date of the confirmation of the order.
DialATire.com has the right to change or revise the price of its products and services displayed on the DialATire.com website at any time and without notice. Price adjustments may occur under the following situations:
- Price increases due to circumstances outside the company’s control, for example, changes in foreign exchange rates, fluctuations in currency regulations; increases in import/export duties, increases in the cost of labour and transportation, or incorrect pricing or pricing errors/omissions made by a manufacturer.
- Any modification made by the Customer to the quantity, quality, specifications, or details of delivery of the ordered Goods.
- Any delay or failure to provide DialATire.com with the necessary information (including documentation) that DialATire.com requires in order to proceed in the safe and timely processing of the order.
In accordance with local UAE law, a standard Value Added Tax (VAT) was introduced from 1 January 2018. Therefore all Goods or Services supplied by DialATire.com will, where applicable, be subject to VAT at a standard rate of 5%. All prices listed on the Site shall be shown exclusive or inclusive of VAT, as may be indicated, and VAT will apply to all invoices and documentation issued to the Customer.
Payment Terms
In the case of any written correspondence between DialATire.com and the Customer, DialATire.com will have the right to entitled for full payment of ordered products and services on the date the Order Confirmation is received. DialATire.com shall have the right, at the discretion of Quick Pit Tires Trading LLC, to charge or debit the Customer's credit/debit card for the total amount that is or becomes owed by the Customer, on the order confirmation date, or at any time thereafter.
The Customer is required to pay for the products and services as referenced in the Order Confirmation in full on the same date as the issuance of the Order Confirmation. DialATire.com retains the right to receive full payment from the Customer regardless of whether the products have been delivered, are in transit, or are in the possession of the DialATire.com. The reference to "payment" in this context shall be a timely payment condition of the Contract. After payment is made in full, an electronic receipt (typically referred to as a invoice) will be issued to the Customer as confirmation of the transaction.
If the Customer does not pay for the products and services before the due date or if the payment is denied or rejected by the Customer's credit/debit card issuer bank, DialATire.com shall, without limiting any of its rights take one or some of the following steps:
- Cancel or suspend the Customer’s order and refuse delivery or performance of the goods or services.
- Determine another payment method to accept payment for fulfilling the order or for any other unpaid transaction(s) or contract(s) with the Customer and DialATire.com.
- Charge a “Customer Fee” or late charge against the unpaid principal balance of any unpaid transaction or contract at 2% per month calculated as above on any unpaid balance until DialATire.com receives payment in full in cleared funds.
These payment obligations under the Contract are enforceable in law by the DialATire.com, and DialATire.com reserves the right to pursue legal or administrative remedies for continued non-payment.
Delivery of Products and Services
As stated in the Order Confirmation received from the Customer, DialATire.com will arrange to deliver the products or provide the installation services at the delivery address identified in the Order Confirmation or at any other address that is authorized by the Customer and approved by DialATire.com. The delivery or installation will be done by the company or its authorized service partners in accordance with the agreement.
Any dates given for delivery or installation in the Order Confirmation are given as estimates only and not guaranteed. DialATire.com will take reasonable efforts to meet the dates indicated, but will not be liable for any delays in delivery or installation due to unforeseen circumstances or other issues outside of DialATire.com’s control. No dates for delivery or installation shall be deemed essential to the Contract unless the delivery dates or installation dates have been expressly confirmed in writing by DialATire.com.
In the situation where the Customer does not take delivery of the products, misrepresents or provides incorrect, misleading, or incomplete information about delivery, or is otherwise unable to accept the products, DialATire.com, without limiting its rights, may choose to take one or more of the following options:
- Place the products in storage pending the receipt of proper delivery information and charge the Customer reasonable storage and handling fees.
- Effectively resell the products on account of the Customer and deduct any fees and costs associated with storage, handling, and administration, as well as any difference in the selling price. Any remaining balance will be credited or refunded to the Customer.
- Return the products to the manufacturer or supplier and charge the Customer for any costs of return and delivery, as well as any administrative costs associated with the return.
Any product returned to DialATire.com or Retired Tire Sales must be accompanied by the original packing slip or delivery note signed and acknowledged by the Customer. The original packing slip or delivery note will be treated as valid evidence of delivery or return and will be the only acceptable evidence of delivery or return of the product.
Risk and Property Conditions
The customer will be responsible for the risk of theft, loss, or damage to the products when the products are delivered to the customer in accordance with the terms set out herein.
At the conclusion of the product sale and installation (per any Tyre installation agreement between DialATire.com and the third-party installer (when applicable)), the customer will be notified when the products have been installed, fitted, or the product is ready for collection.
Notwithstanding the transfer of risk, the ownership of the products shall remain with DialATire.com until full payment of the total amount due — including all applicable fees and charges — has been received from the customer.
The customer shall have no right to claim ownership, lien, or any form of security interest over the products as a result of any outstanding balance owed. Should such a claim be made, the entire amount due to DialATire.com shall become immediately payable without the need for further notice, prejudice, or recourse.
Conditions of Return
Customers may cancel their order, return the products, or decline the services to request a refund, provided that the products remain unused, undamaged, and in the same condition as originally received. Such requests must be made within 7 days from the order date. The customer will be responsible for any costs associated with returning the products to DialATire.com.
DialATire.com reserves the full right to approve or deny any refund request at its sole discretion. In cases where a refund is approved, any applicable handling, processing, or service charges incurred by DialATire.com in facilitating the refund will be deducted from the refundable amount before it is issued to the customer.
Liability Conditions
DialATire.com will not be responsible for any issues arising from incomplete or incorrect information provided by the customer on the order form. Any losses, incorrect product selection, or delivery issues will remain the responsibility of the customer due to the information supplied by the customer.
DialATire.com will not be responsible for product damages caused by normal wear and tear, misuse, failure to follow the instruction manual for standard usage or, usage or operating under inappropriate conditions.
To the maximum extent permitted by applicable law, all warranties, conditions, and terms implied by statute or common law, are hereby expressly excluded unless set forth in these terms.
Customers must inform DialATire.com in writing of any product defect, quality issue, or issue with product specs within 48 hours of delivery or service completion, or 24 hours of discovering such defect.
The right to cancel the order, reject the product, or seek compensation is lost if notice is not provided within the specified time.
If, after investigation, a customer's request regarding a product defect, quality issue, or improper service installation is validated, DialATire.com may, in its sole discretion, choose to replace the product, re-perform the service at no charge or issue a refund per the refund policy. DialATire.com has exclusive rights to refund a purchase, replace or issue service credits.
DialATire.com is not responsible for misrepresentation, implied warranty, or breach of contract, nor for direct, indirect, incidental, or consequential loss or damage resulting from the use, installation, or resale of the products. In no event shall DialATire.com be liable in excess of the amount paid by the customer for the item or service in question.
If ordered products are not available to be shipped, DialATire.com may cancel the order and issue a full refund for the products or services, with no further obligation to the customer.
DialATire.com is not liable for any delay, failure of performance, or breach of contract due to causes beyond its reasonable control, including, without limitation, causes arising out of force and nature, the act of government, or of the supply chain.
General Terms
DialATire.com can conduct any aspect of its tasks and obligations described in these terms either directly or through authorized third parties, partners, service providers, or other parties as appropriate.
All notices, requests, or approvals under these terms must be in writing and delivered to DialATire.com, and DialATire.com will issue its notices or communications to the customer at the principal or registered business address at the time of notice.
Any waiver granted by DialATire.com for a breach of contract shall not be considered a waiver for any future or similar breach of the same or other provisions.
If a jurisdiction finds any clause or part of an clause hereof, or provision of these terms, invalid or unenforceable, the remaining terms will remain effective and enforceable.
These Terms and Conditions, together with the order confirmation, form the complete and final agreement between the customer and DialATire.com for the purchase and sale of products or services. They supersede all prior written or verbal communications, representations, or agreements. The customer acknowledges that they have not relied on any statements, promises, or representations made by DialATire.com employees, agents, or representatives that are not explicitly included in this agreement.
DialATire.com reserves the right to assign or transfer all or part of its contractual rights and obligations to a third party as necessary. The customer, however, may not assign or transfer any part of this agreement or related benefits without prior written consent from DialATire.com.
These terms and all related transactions are governed by the laws of the United Arab Emirates, and the customer agrees to submit to the non-exclusive jurisdiction of UAE courts for any disputes arising under these terms.
The use of DialATire.com and online ordering is available only to those who are 18 years of age or older. Users who are below this age may not register, place orders, or engage in any financial use of the site.
DialATire.com has the capability to accept payments in AED via secure online credit and debit payment methods. Please ensure you save copies of any transaction records and review your merchant agreement to be clear on the terms and conditions.
DialATire.com will not ship products to or engage in transactions with any person or entity in any OFAC sanctioned country, in accordance with UAE law.
